爭「凱瑟琳」 台北告贏中壢

位於台北的凱瑟琳婚紗攝影公司，在5年前發現自己註冊使用的「凱瑟琳CATHERINE」商標，被中壢同業「凱瑟琳婚紗精品旗艦店」拿去使用，台北凱瑟琳一狀告上法院，中壢凱瑟琳的創辦人因此被依《商標法》判刑3個月，得易科罰金外，民事部分又被最高法院判決要賠償110萬元定讞。 雖中壢凱瑟琳主張，己花了幾百萬元在媒體廣告宣傳，為「凱瑟琳婚紗精品旗艦店」打廣告，且2家公司主要客源分別在台北、桃園，幾無重疊，中壢凱瑟琳絕非利用台北凱瑟琳商標營業。 但智慧財產法院調查後認為，的確有少部分網友誤認中壢凱瑟琳與台北凱瑟琳是關係企業，可見商標近似已經造成混淆，因此判中壢凱瑟琳共要賠償台北凱瑟琳110萬元。案經最高法院駁回上訴定讞。（劉昌松／台北報導） 【更多新聞，請看《蘋果陪審團》粉絲團】
